We at CNJNET/Computown, LLC, are your Internet & web-hosting provider. As one of our customers, you have certain rights. The most important one is to be provided with the most up to date domain hosting services possible. You also have certain obligations, which you must follow in order to insure everyone who dials into our network has an enjoyable experience.

You will also be obligated to read and familiarize yourself with all of the rules and obligations below and follow them as they are your contract with us and will remain in effect for the entire time you are with us.

These policies below apply to our web-hosting, and dial-up customers, as well as to our customers who use our computer/laptop repair services.


INITIAL SIGN-UP AND LOG-IN POLICIES:

1. Upon sign up, you will indicate the length of your service term, monthly, yearly, etc. The term of your services will affect the actual rate you pay and this will be explained before you begin service with us.

2. To our remaining dial-up customers: You will only be allowed to one log-on at a time. Anyone who attempts to log-on with more than one computer at a time shall be issued two warnings. The third time a customer is caught logging-on with more than one computer, he/she shall have their service and contract terminated immediately with no further notice and no refund shall be given for unused time. Also Dial-Up Internet service is NOT UNLIMITED. Each account is given 150 hours per month or 5 hours per day. Customers going over this time limit will be given a warning and upon subsequent violations their service will be terminated.

2a.  WE DO NOT WARRANT OR PROMISE THAT ANY OF OUR NUMBERS ARE LOCAL TO YOU. IN PARTICULAR, WE URGE YOU TO NOTE THAT EVEN AN ACCESS NUMBER THAT SHARES YOUR AREA CODE OR APPEARS TO BE LOCATED IN YOUR GENERAL GEOGRAPHIC REGION MAY NOT NECESSARILY BE A LOCAL NUMBER TO YOU. SUBSTANTIAL TOLL TELEPHONE CHARGES MAY APPLY TO NUMBERS THAT YOU DO NOT VERIFY AS LOCAL TO YOUR INDIVIDUAL AREA OR CALLING PLAN. We are not responsible for any toll charges that you may receive.

2b. CNJNET/Computown, LLC will not be held responsible for persons or companies that host their own E-mail servers. If said servers cannot receive mail through any dialup connections.


3. We require a credit card on file and we will need all relevant information to process payment at the end of each month.  You will need to authorize CNJNET/Computown, LLC to charge your credit card at the beginning of the month for the service at the agreed upon terms and price. If your credit card subsequently expires, it shall be your obligation to provide CNJNET/Computown, LLC with a substitute valid credit card.

4. All check customers shall be forwarded an invoice (based upon their service term) and all customers are obligated to pay their invoice within 15 days of receipt or by the 5th of the month in which the bill becomes due, whichever is first. The timely payment of your bill insures that we can keep your dial-up, e-mail and web hosting services up to par with the fast changing Internet.

5. Any customer who issues a check that is returned for any reason shall be charged a fee of $35.00.

6. For Internet, web hosting and email customers, CNJNET/Computown, LLC will automatically bill you prior to the end of your term of service. If you wish to cancel your service with us CNJNET/Computown, LLC, it is your obligation to notify us of this. We must be notified in writing, either by e-mail or written letter. You will be obligated to pay for any remaining time left on your agreed term of service. If CNJNET/Computown, LLC is not notified in writing (with confirmation by us), that you wish to cancel your service, your agreed terms of service shall be renewed at the same rate and all rights and obligations shall apply.
 

6a. Monthly customers shall be obligated to notify CNJNET/Computown, LLC no later than 15 business days before the start of a new month of their desire to cancel their internet or web-hosting services otherwise they will be obligated to pay for the entire new month of service.

6b. Annual accounts shall be obligated to notify CNJNET/Computown, LLC no later than 15 business days before the start of their new service term to cancel without penalty.


6c.  If you cancel and have an open balance for a previous month you are obligated to that balance. If your credit card has already been billed for the month or year, you will be obligated for that month or year of service and will be put on the cancellation list before the next scheduled billing cycle.


**Note** No Phone cancellations will be accepted. All cancellations must be in writing, either via E-Mail to billing@cnjnet.com or letter addressed to: Computown, LLC 557 Bound Brook Rd. Middlesex, NJ 08846. No faxes or phone calls will be accepted. (billing@cnjnet.com). You are responsible for payment for your service, even if there is a delay in getting an invoice to you.

7. CNJNET/Computown LLC may cancel or suspend your account, privileges or website for any reason without prior notice (most times this is a result of non-payment, or a delinquent, past due account). CNJNET/Computown, LLC shall have no liability whatsoever including but not limited to loss of business, damages of any kind.

7a. If your account is delinquent CNJNET/Computown, LLC shall, upon receiving your payment, reinstate your account and you may be charged a $25 reconnect fee, and shall be obligated to make all further invoice payments in a timely manner as described above.

CUSTOMERS USAGE LIMITATIONS:

1. It shall be unlawful and a violation of our policies and possible State and Federal Law for any of our customers to hack into our network or to hack into some other network using our service. Don't Do It! If caught hacking, you will be immediately terminated and your information provided to the proper authorities.

2. It shall be a violation of our rules and regulation if any of our customers send SPAM, (Bulk unsolicited E-mails) through our network. Do Not Do It!  Any customer caught sending Spam through our network will be immediately terminated without refund for any unused time.

3. Copyrights and Trademarks.
All hosted sites that contain elements of text, graphics, photos, designs, trademarks, or other artwork must be owned by you, or that the Client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, indemnify and defend CNJNET/Computown LLC (including attorney's fees and court costs), including any claim or suit, threatened or actual, arising from the use of such elements furnished by the Client.    You shall not cause the unauthorized duplication through our network of software or other data that is copy-written without the payment of the appropriate fee to the writer or developer of that medium.

4. Electronic Commerce Laws.
You are solely responsible for complying with any laws, taxes, and tariffs applicable in any way to the Web site hosted by CNJNET/ Computown LLC or any other services contemplated herein, and will hold harmless, protect, and defend CNJNET/Computown LLC and its subcontractors from any claim, suit, penalty, tax, fine, penalty, or tariff arising from the Client's exercise of Internet electronic commerce and/or any failure to comply with any such laws, taxes, and tariffs.

5. You shall not send any E-mail’s or other transmissions under a false or assumed name.

6. You shall not cause obscene or illegal material to be transmitted over our network.

7. You shall conduct yourself in a manner that is courteous and not offensive to other users of our network and or other networks.

8. Any violations of the above limitations shall subject the customer to immediate termination without refund and the determination of the sanction herein shall be at the discretion of CNJNET/Computown, LLC and that determination shall be binding and final.


LIMITATION OF LIABILITY:

1. CNJNET/Computown, LLC shall not be liable for any damage or loss whatsoever to your computer or related equipment, your hardware, software, files and information due to any causes, including but not limited to, viruses, electrical spikes, lightning, or power outages. CNJNET/Computown, LLC shall also not be liable for subsequent damages to you or your business customers, that result in the loss of any business or data due to damage or loss of any and all information, files, hardware or software for any of the reason stated herein above.

2. We request that if you have any important data that you need or cannot do without that you back it up! This is the only way you are assured that you will not lose it. If you have it only in your hard drive, your hard drive may be susceptible to viruses or crashing and loss of data. Remember, if hackers can break into Microsoft's system, they can break into yours.

 

3. Although we provide back up for websites, it is the responsibility of the web designers that host with us to keep local back ups.



ADDITIONAL INFORMATION AND GUIDELINES:

1. You may not use any personal web pages for commercial or business use, CNJNET/Computown, LLC shall have no liability whatsoever including loss of business. Your personal web page(s) is only for that purpose. Use of the personal web server shall include no guarantees of uptime. If you use the personal web server for hosting of pictures for auction purposes, it is at your own risk and no compensation shall be issued for loss of any information, sales or any losses whatsoever.

2. CNJNET/Computown, LLC reserves the right to change, modify or add to these Rules and Regulations at any time without prior notification. It is your obligation to read and refer to them from time to time to insure you agree with all the terms and conditions set forth.

3. These Rules and Regulations are valid upon posting and you agree to accept and abide by them unless you notify us in writing within (7) days from the original posting date.

4. If you are found in any violation of the Rules and Regulations, CNJNET/Computown, LLC reserves the right to cancel or suspend your service without prior notice to you and no refund will be due you for unused service.

5. CNJNET/Computown, LLC will not responsible for the content of any E-Mail, newsgroups, or other content that you may see during your searches on the internet. If certain material offends you, do not read or view the material on the offending site.

6. If you cancel your account with CNJNET/Computown, LLC your E-mail cannot be forwarded to any other Company.

7. If you cancel your account with CNJNET/Computown, LLC and continue to use your E-mail you are liable for all and any payments for use of that account.

8. Unless otherwise specified, CNJNET, Net-Lynx, Na2k.net Netaccess2000 and any other domains owned or affiliated with Computown, LLC Sites/Services are for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the sites listed and not listed within our Sites/Services is strictly prohibited.
